Kathmandu: Former Inspector General of Police (IGP) Dan Bahadur Karki, who was removed from his position on Wednesday, is preparing to approach the Supreme Court, seeking reinstatement as Nepal Police chief.
According to a lawyer close to Karki, the petition will argue that removing a serving police officer from his position without a valid legal basis violates the Nepal Police Act.
The writ petition is expected to argue that provisions under the Police Act, 2012 and the Police Regulations, 2014 do not provide grounds for removing Karki, as he has not reached the prescribed limits concerning service tenure, tenure in office or age.
Karki joined Nepal Police on April 1, 1998 (Chaitra 18, 2054 BS). Under the existing Police Regulations, the maximum service period for the Inspector General of Police is 30 years, while the retirement age is 58.
Born on July 30, 1972 (Shrawan 15, 2029 BS), Karki is currently 54 years old. The tenure of the IGP is four years, and Karki would have completed one year in office on November 13 (Kartik 27).
The petition is expected to challenge the legal grounds for his removal, arguing that none of the prescribed retirement or tenure conditions had been met.
Nepal Bar Association President Bijaya Mishra, Senior Advocate Bhimarjun Acharya and Govinda Bandi are among the legal professionals expected to represent Karki in the case.
